Last updated: June 30, 2026
Overview
These Terms and Conditions (“Terms”) govern your access to and use of the OPUS Music Competition website, registration forms, application portals, and related services (collectively, the “Services”). By accessing or using the Services, registering for OPUS, submitting an application, purchasing tickets, or otherwise participating, you agree to these Terms.
If you do not agree, do not use the Services.
1. Eligibility and Participation
OPUS is open to eligible participants as described in the applicable competition rules, category descriptions, and posted guidelines (the “Competition Rules”).
Participants under 18 must have permission from a parent or legal guardian, and a parent/guardian may be required to complete registration steps on the participant’s behalf.
You are responsible for ensuring that all eligibility requirements (including age/category placement, repertoire, and deadlines) are met.
2. Accounts, Registration, and Accuracy of Information
You agree to provide accurate, complete, and current information in all registration forms, applications, and communications. You are responsible for maintaining the confidentiality of any login credentials and for all activity under your account (if applicable).
3. Competition Rules, Deadlines, and Changes
OPUS operates according to the Competition Rules posted for each season/year. The Competition Rules are incorporated into these Terms by reference.
OPUS may update schedules, formats, venues, adjudicator rosters, prizes, categories, and deadlines when necessary (for example, operational needs, force majeure, or safety concerns). We will make reasonable efforts to communicate material changes.
4. Submissions, Recordings, and Applicant Materials
OPUS may require the submission of materials such as: audio/video recordings, repertoire lists, identification or age verification, photographs, biographies, resumes/CVs, written materials, and similar content (“Submission Materials”).
By submitting Submission Materials, you represent and warrant that:
You own the materials or have all necessary rights, permissions, licenses, and consents to submit them;
Your submission does not infringe or violate any third-party rights (including copyright, privacy, publicity, or moral rights);
Any minors appearing in the Submission Materials have appropriate parent/guardian consent.
OPUS is not responsible for submissions that are incomplete, corrupted, late, or otherwise not received due to technical issues.
5. Permission to Use Submission Materials (Competition Purposes)
You grant The OPUS Organization, LLC a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and internally share Submission Materials as necessary to administer the Competition, including but not limited to:
sharing with adjudicators and staff for evaluation;
producing programs, internal records, and competition operations;
communicating results and participant information consistent with Competition Rules.
6. Media, Promotion, and Publicity
Unless prohibited by the Competition Rules for a specific category or season, you grant OPUS permission to use participant names, likenesses, photos, audio/video submissions, and biographical information for Competition-related publicity and promotional purposes (for example, website posts, social media, press releases, program books, and event recap content), without additional compensation.
If you need a media opt-out due to safety or privacy concerns, contact us. OPUS will consider reasonable requests, but some public recognition, including winner announcements, may be required for Competition integrity. Requests by winners to remove or take down Winner Media after accepting Prize Money are governed by Section 7.
7. Prize Money, Winner Media, and Removal Requests
If a participant is selected as a winner and accepts any cash prize, scholarship award, honorarium, stipend, or other monetary award from OPUS (“Prize Money”), the winner acknowledges and agrees that the Prize Money is awarded in part in consideration of OPUS’s right to identify the participant as a winner and to use, publish, display, distribute, and promote the winner’s name, likeness, photographs, audio/video recordings, performance footage, Submission Materials, biographical information, and related Competition media (“Winner Media”) for Competition-related publicity, archival, educational, promotional, and recap purposes.
A winner may request, in writing, that OPUS remove or take down Winner Media from websites, social media accounts, video platforms, or other channels controlled by OPUS. OPUS will make reasonable efforts to remove such Winner Media from OPUS-controlled platforms within a reasonable time after receiving the written request, subject to technical, archival, legal, administrative, or third-party platform limitations. OPUS is not responsible for copies, reposts, shares, downloads, media coverage, embeds, cached content, or other uses of Winner Media by third parties that are outside OPUS’s control.
If a winner requests removal or takedown of Winner Media after accepting Prize Money, the winner must return the full amount of Prize Money received from OPUS within thirty (30) days of the request, unless OPUS agrees otherwise in writing. The parties agree that this repayment obligation is not a penalty, but a condition of accepting Prize Money and a material part of the exchange between OPUS and the winner, because OPUS awards Prize Money in reliance on its ability to publicly recognize, promote, document, and archive Competition winners.
Failure to return Prize Money as required under this section may result in forfeiture of winner status, removal from future OPUS promotional materials, ineligibility for future OPUS competitions or awards, and any other remedies available to OPUS under these Terms or applicable law.
8. Fees, Payments, and Taxes
Registration fees, application fees, ticket prices, and any optional purchases will be disclosed at the time of purchase or registration.
You authorize OPUS and its payment processors to charge the payment method you provide for applicable fees.
You are responsible for any taxes, currency conversion fees, or bank charges related to your purchase.
9. Refunds and Chargebacks
Unless the Competition Rules state otherwise:
Competition application/registration fees are generally non-refundable, including if you withdraw, are disqualified, miss deadlines, or do not attend.
Ticket refunds (if applicable) may be subject to the posted ticketing policies and venue policies.
If OPUS cancels an event or category, OPUS may offer a refund, credit, deferral, or alternative format at its discretion.
Initiating a chargeback without first contacting us to resolve a billing issue may result in disqualification from current or future OPUS events.
10. Code of Conduct and Fair Use
You agree to engage respectfully with participants, families, adjudicators, staff, volunteers, and venues. OPUS may, at its discretion, remove or disqualify any person for conduct that undermines fairness, safety, or the integrity of the Competition, including harassment, threats, cheating, falsification, plagiarism, or misuse of OPUS platforms.
11. Intellectual Property
The OPUS name, logos, website content, branding, text, graphics, documents, and materials provided by OPUS are owned by The OPUS Organization, LLC or its licensors and are protected by intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from OPUS materials without prior written permission, except as allowed by law.
12. Third-Party Services and Links
OPUS may use third-party platforms for payments, registrations, file hosting, video hosting, communications, ticketing, or analytics. Your use of those services may be governed by their separate terms and privacy policies. OPUS is not responsible for third-party services.
13. Disclaimers
The Services are provided on an “as is” and “as available” basis. OPUS does not guarantee uninterrupted or error-free operation, nor does OPUS guarantee outcomes, rankings, prizes, or results. Adjudication is inherently subjective and conducted according to OPUS procedures and Competition Rules.
14. Limitation of Liability
To the maximum extent permitted by law, The OPUS Organization, LLC and its officers, directors, employees, contractors, volunteers, and affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services or participation in OPUS, including loss of data, lost profits, or reputational harm.
To the extent permitted by law, OPUS’s total liability for any claim will not exceed the amount you paid to OPUS for the applicable registration or purchase giving rise to the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless The OPUS Organization, LLC and its affiliates, officers, directors, employees, contractors, and volunteers from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from:
your Submission Materials;
your violation of these Terms or Competition Rules;
your infringement of any third-party rights;
your misuse of the Services.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Services shall be brought in the state or federal courts located in Clark County, Nevada, and you consent to personal jurisdiction there.
17. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date reflects the current version. Continued use of the Services after changes become effective means you accept the updated Terms.
